Appeals

Q        How many days does an employee have to appeal against the rejection of their flexible working request?

A       14 days.

Q        Does an employee with less than a year's service have the right to appeal against their dismissal?

A        Yes, under the statutory disciplinary and dismissal procedures every employee, regardless of length of service, has the right to appeal against any disciplinary action taken against them.

Q       One of our managers held a grievance meeting with a member of staff and advised her in writing that he was not upholding her complaint.  She wants to appeal against this decision.  Can the same manager hear the appeal?

A       Wherever possible, a different person should hear the appeal.  The same manager is very unlikely to overturn his original decision and therefore the appeal needs to be considered objectively by a third party.
