Q. Can I ask an employee to prove their right to work in the UK?

A. Yes.  It is best practice to ask all applicants to bring appropriate documentation to the interview to prove they have the right to work in the UK. This will provide you with the statutory defence and help you to avoid fines for illegally employing a worker. A word of warning, don't just ask applicants you think might not have the right to work in the UK as this will leave you open to claims of race discrimination.
