Compromise Agreements

 

Q        What is a compromise agreement?

A        This is when an employee signs away their right to bring an employment claim at a Tribunal, usually in return for a sum of money. However, in order for the compromise agreement to be legally binding the employee has to seek independent legal advice from an employment solicitor, which is paid for by the employer.  Compromise agreements can be incredibly useful, but used too frequently you risk creating a culture where everyone expects to be paid off, plus you are sending an employee into the arms of a solicitor who may wish to negotiate a better settlement for their client.
