Q On several occasions a member of staff has verbally complained about one of his colleagues calling him names. Do I have to treat this as a formal grievance?
A Technically a grievance should be raised in writing. However, if you are aware of issues or problems between staff, you shouldn't ignore it and should investigate the situation to see if you need to take any further action.
Q What does the 3-step statutory grievance procedure involve?
A Step 1 is that the employee should provide a written statement regarding their grievance. Step 2 involves holding a meeting with the employee, at which they have the right to be accompanied by a colleague or an accredited trade union representative, to discuss their grievance and try and find an appropriate resolution. Step 3 is the right to appeal against the outcome of the grievance. From April 2009, grievance procedures will no longer be subject to the statutory grievance procedure and we recommend that you should follow the ACAS Code of Practice.
