Last in First Out

 

Q        For many years, whenever we have had to make redundancies in our engineering division we have used last in first out as our selection criterion.  Is this still ok?

A        Due to age discrimination you will need to be careful with using this selection criterion as, on its own, it is likely to be unfair. Younger employees can argue that due to their age they have not been able to accrue the same length of service as older workers. However, it can still be used as part of broader selection criteria, if you can demonstrate that it is relevant.
