Q        We offer a number of benefits which increase with length of service, is this acceptable?

A        Any benefits which increases based on length of service of up to five years are acceptable under the Equality (Age) Regulations.  However, it is unlawful to use length of service as a criterion for the provision of additional benefits unless it can be shown that the criterion was to fulfil a business need, for example, encouraging loyalty or motivation.
