Overtime

 

Q        Do I have to pay overtime at a higher hourly rate than an employee's normal basic hourly rate?

A        No, there is no obligation to do so unless your contract of employment says you will.  However, some companies choose to offer enhanced overtime rates to encourage people to work unsociable hours or weekends. 

 

Q        I believe a member of staff has been claiming more overtime than they have working. Can I take disciplinary action against them?

A        Yes.  You need to carry out a disciplinary investigation to substantiate your beliefs, but falsely claiming overtime is tantamount to fraud and can be addressed through your company's disciplinary procedures.
