Probationary Period

 

Q        We have an initial three month probationary period in our contract of employment which allows us to terminate employment with one week's notice.  One of our employees is not making the grade but the probationary period has just expired. Do we have to pay full notice when we terminate their employment?

A        Yes; by allowing the probationary period to expire without addressing the problem, you have effectively confirmed employment even if you have not held a review with your employee.  You must pay full notice.
