Public Interest Disclosure

 

Q        One of my employees has raised some concerns about the disposal of some of our waste products and the environment.  We have investigated and made a few minor changes to our procedures but we feel this person is a troublemaker and would like to remove him from the business.  He has less than a year's service so he can't claim unfair dismissal, can he?

A        If he's raised environmental concerns this is likely to be classed as a protected disclosure and therefore any dismissal related to this would automatically be unfair.  Furthermore, under the Whistle-blowing Regulations he doesn't need to have the 12-months' qualifying service to claim unfair dismissal.  If you are looking to dismiss him for other reasons, that may be acceptable but you will need to have a good paperwork trail to show it was unrelated to him making a public interest disclosure.
