Redundancy

 

Q        We are considering making 5 people redundant, do we have to consult for a minimum of 30 days?

A        No; there is no minimum consultation period where less than 20 employees are affected by redundancy.  However, there is still a legal requirement to undertake full and proper consultation.  The 30-day limit applies when between 20 and 99 staff are affected, and there is a 90-day consultation period where 100 or more employees are affected.

 

Q        One of the people I have selected for redundancy is 67 years' old. I don't have to pay him any redundancy pay, do I?

A        It depends on his length of service.  If he has continuous service of more than two years he is entitled to statutory redundancy pay in the normal way.

 

Q        I no longer have enough work for my full-time employee and have offered her work three days a week. Do I have to pay her redundancy pay if she does not accept the reduction in hours?

A        Yes; you are making a fundamental change to her terms and conditions and as the original full-time role no longer exists, she can claim redundancy.
