Q        Our Company's normal retirement age is 65.  Is this still acceptable under the age discrimination regulations?

A        Yes.  The default retirement age is currently 65, but this is subject to review in 2011.

 

Q        An employee who is due to retire in 3 months' time has asked to continue working beyond his retirement date, do we have to accept that request?

A        No, but in order for any retirement to be fair you must follow the statutory notification of retirement procedures. Furthermore, now that he has submitted a request you have a duty to consider this properly and if you reject his request he will have the right to appeal against this decision.

 

Q        One of our female employees has said that she wants to retire on her 60th birthday, but I thought that the retirement age for both men and women is 65.  Is this correct?

A        A company cannot have a compulsory retirement age lower than 65 unless it can be objectively justified and therefore both men and women should be permitted to work until they are 65. However, in this situation you can treat the employee's desire to retire at 60 as a resignation rather than a retirement.  Therefore, it would be advisable to ask her to put her intentions to you in writing.
